Terms of Service

1. Eligibility

You must be at least 18 years old, or the age of majority in your state of residence, and have the legal capacity to enter into a binding contract to place an order with us. By using our site, you represent that you meet these requirements.

2. Products, Pricing & Availability

All product descriptions, images, and prices are provided in good faith and to the best of our knowledge; however, we do not warrant that they are always complete, accurate, or free of error. Prices are listed in U.S. dollars and are subject to change without notice.

We reserve the right to limit quantities, refuse service, or cancel any order — including after an order confirmation has been sent — if a product is listed at an incorrect price, is out of stock, or if we suspect fraud or unauthorized activity. If we cancel an order for these reasons, we will notify you and issue a full refund for any amount charged.

3. Orders & Order Acceptance

Placing an order is an offer to purchase, and no order is accepted until we send you a shipping confirmation. We reserve the right to accept or decline any order for any lawful reason, including suspected fraud, errors in pricing or product information, or issues with payment or delivery details.

4. Payment

We accept the payment methods displayed at checkout, processed securely through our payment provider. By placing an order, you authorize us, or our payment processor, to charge your selected payment method for the full amount of your order, including applicable taxes and shipping costs. You represent that all payment information you provide is accurate and that you are authorized to use the payment method provided.

5. Shipping & Delivery

Estimated delivery is 8 to 21 business days from the date your order is processed. Delivery times are estimates only and are not guaranteed. Risk of loss and title for products pass to you upon our delivery of the item to the shipping carrier, though we remain available to assist with any carrier-related issue.

6. Returns, Exchanges & Refunds

Returns, exchanges, and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms by reference. Please review that policy before placing an order.

7. Product Authenticity & Warranty

Every watch sold by Caliber Crest is guaranteed authentic. Manufacturer warranties, where applicable, are honored in accordance with the manufacturer's own terms and are separate from the return rights described in our Return & Refund Policy.

Except as expressly stated in these Terms or required by law, products are sold without any additional warranty of merchantability or fitness for a particular purpose, to the fullest extent permitted by applicable law.

8. Intellectual Property

All content on our site, including text, graphics, logos, images, and the Caliber Crest name and marks, is the property of Caliber Crest or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written consent.

9. Prohibited Uses

You agree not to use our site to:

• Violate any applicable law or regulation;
• Infringe our intellectual property or that of any third party;
• Transmit harmful code or attempt to gain unauthorized access to our systems;
• Scrape, harvest, or collect data from our site without our permission;
• Place orders using stolen or unauthorized payment information, or otherwise engage in fraudulent conduct.

10. Third-Party Services

Our site is hosted on the Shopify platform and may rely on third-party services for payment processing, shipping, analytics, and marketing. We are not responsible for the acts or omissions of these third parties, though we select them with care. Your use of our site is also subject to our Privacy Policy, which describes how we collect and use your information.

11. Limitation of Liability

To the fullest extent permitted by law, Caliber Crest will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our site or products, even if advised of the possibility of such damages.

Our total liability for any claim arising from your order will not exceed the amount you paid for the product giving rise to the claim. Nothing in this section limits any liability that cannot be excluded or limited under applicable law.

12. Disclaimer of Warranties

Our site and its content are provided "as is" and "as available," without warranties of any kind, either express or implied, to the fullest extent permitted by applicable law.

13. Indemnification

You agree to indemnify and hold Caliber Crest, its owner, and its service providers harmless from any claims, damages, or expenses arising from your violation of these Terms or your misuse of our site.

14. Force Majeure

We will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, customs delays, carrier disruptions, or other events of force majeure.

15. Governing Law & Disputes

These Terms are governed by the laws of New South Wales, Australia, the jurisdiction in which Caliber Crest is legally established, without regard to conflict-of-law principles. This choice of law does not deprive you, as a consumer, of any protection afforded to you by mandatory, non-waivable provisions of the law of your state of residence.

16. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Return & Refund Policy and Privacy Policy, constitute the entire agreement between you and Caliber Crest regarding your use of our site.

17. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised Effective Date, and your continued use of our site after changes take effect constitutes acceptance of the updated Terms.
